Seeking to obtain outline planning permission for residential development of approximately 87 units on former GAA grounds at Leyland Road, Ballycastle.

Issues Encountered

  • Originally 4 reasons for refusal were provided by the Department however following negotiations and in advance of the hearing, the Department withdrew two of its refusal reasons.
  • On the hearing day, both parties focused on the loss of open space as well as residential amenity issues raised by objectors.
  • Conflicting views between the Department of Environment and the Strategic Planning team as to whether the appeal site was open space of public value.

Our Involvement

We were appointed on behalf of Manor Homes to handle a planning appeal against the refusal of outline planning permission for housing. We prepared a detailed statement of case and acted as planning witness at the informal hearing of the appellant. In addition, we proactively gained the unanimous support of Moyle District Council for this case.

The appeal was allowed on the grounds that site did not fall within the definition of open space of public value. The DoE tried to push for 20% social housing and a play facility in the scheme, but both were rejected by the Commission.
